TERMS AND CONDITIONS – PARTY EQUIPMENT RENTAL

These Terms and Conditions (“Agreement”) govern the rental of party equipment and services provided by:

By renting equipment from the Company, the Customer agrees to the following terms:

The Company agrees to rent party equipment (including but not limited to bounce houses, tents, tables, chairs, concessions, and related items) to the Customer for the agreed rental period.

The Customer accepts full responsibility for the equipment from the time of delivery until it is returned or picked up by the Company.

• A deposit of $100 may be required to secure a reservation.
• Full payment is due prior to or at the time of delivery unless otherwise agreed.
• Accepted payment methods: Cash, Zelle, Venmo, Cash-app.
• Failure to pay may result in cancellation of the rental.

• Cancellations made 3 days prior to the event may receive a partial refund.
• Deposits may be non-refundable unless otherwise stated.
• Same-day cancellations may forfeit all payments.
• Weather-related cancellations may be rescheduled at the Company’s discretion.

• Delivery and setup will occur at an agreed time window.
• The Customer must ensure clear access to the setup area.
• Equipment will be picked up at a scheduled time; additional fees may apply for delays or after-hours pickup.
• The Customer must be present or provide clear instructions for setup.

The Customer agrees to:

• Provide a safe, level, and clean setup area.
• Ensure adequate space and electrical access (if required).
• Supervise all equipment use, especially for inflatables.
• Follow all safety instructions provided by the Company.
• Prevent misuse, damage, or theft of equipment.

• Equipment must be used only for its intended purpose.
• The Customer shall not sublease, transfer, or allow unauthorized use.
• Certain items (e.g., inflatables) require constant adult supervision.
• The Company reserves the right to terminate use if unsafe conditions are observed.

• The Customer is responsible for any loss, theft, or damage beyond normal wear and tear.
• Cleaning fees may apply if equipment is returned excessively dirty.
• Repair or replacement costs will be billed to the Customer.

• The Customer assumes all risks related to weather conditions.
• Certain equipment (especially inflatables and tents) must not be used in high winds, rain, or severe weather.
• The Company may cancel or refuse setup if conditions are deemed unsafe.

Use of rented equipment involves inherent risks. The Customer assumes all liability for injuries or damages arising from use of the equipment.

To the fullest extent permitted by law, the Company shall not be liable for:

• Personal injury or death
• Property damage
• Losses resulting from misuse or failure to follow instructions

The Customer agrees to indemnify, defend, and hold harmless the Company, its owners, employees, and agents from any claims, damages, or expenses arising from the rental or use of the equipment.

The Customer is responsible for obtaining any necessary permits, permissions, or approvals required for equipment use (including HOA, city permits, or park permissions).

The Customer must provide adequate power sources for equipment requiring electricity. Generators may be required if power is not available and may incur additional fees.

The Company shall not be held responsible for failure to perform due to circumstances beyond its control, including but not limited to weather, accidents, equipment failure, or acts of God.

This Agreement shall be governed by the laws of the State of Texas.

These Terms and Conditions constitute the entire agreement between the parties and override any prior agreements or understandings.

By accepting delivery of equipment, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
